What the report examines
A multidisciplinary analysis of the EU proposal on online child sexual abuse, addressing general monitoring, proportionality, private communications, adolescent sexual exploration, voluntary detection and institutional safeguards.
- Examines whether detection obligations engage the prohibition of general monitoring and how Article 52 of the EU Charter should discipline the proposal’s proportionality analysis.
- Addresses consensual online sexual exploration between adolescents, age verification, end-to-end encryption, voluntary detection and the relationship between the proposed EU Centre and EUROPOL.
- Records areas of common ground on risk assessment, child-friendly reporting, less intrusive measures, independent institutional design, law-enforcement capacity and children’s participation.
Publication context
The report arose from an expert workshop jointly organised by Leiden University’s eLaw centre and ECPAT International with Council of Europe support. Dr Leiser and Dr Witting presented it to the Lanzarote Committee during its exchange with the European Commission in February 2023.
